Research On Legal Issues Of Landfill Ecological Restoration In China

With the rapid development of urbanization,the sharp increase of population and the continuous improvement of productivity level in China,the material life has been greatly satisfied,but at the same time,it also brings the grim reality of environmental pollution.The negative effect of urban garbage has become one of the main environmental problems affecting the social development of our country in the new era.In China,the problem of ecological restoration after landfills have been destroyed starts late,the efficiency of treatment is low,and the Countermeasures for ecological restoration of landfills are inadequate.The relevant legal systen concerning landfills needs to be improved urgently.The ecological problem of landfill formation is a multi-disciplinary problem that integrates environment,economy and society.It has a negative impact in all fields of social development.In order to achieve sustainable economic and social development and coordinate the relationship between environmental protection and economic development,China should actively explore and solve the legal problem of ecological restoration of landfill.The purpose of this paper is to define the connotation of ecological restoration and ecological restoration of landfill through the analysis of the environmental impact,ecological impact and regional plot impact of landfill,and to focus on the analysis of the legal provisions,system status and legal issues of ecological restoration of landfill in China.The comprehensive environmental protection law,separate law,adlinistrative regulations,departmental regulations and local regulations are also discussed.Regulations and environmental protection standards are sorted out and refined,and the legal problems existing in ecological restoration of landfill in China are summarized.The main problems are lack of special legislation,lack of stable financing channels,unclear responsibility subjects and responsibility sharing,lagging evaluation of soil environmental quality standards,unclear bottom of landfill,identification procedures and risk assessment system need to be improved,and reference from foreign countries for garbage control.Advanced experience of landfill ecological restoration,such as multiple restoration models and financing systems,scientific landfill environmental management information system,responsibility and undertaking mechanism for landfill restoration suited to national conditions,and perfect legal and technical standards.On this basis,based on China's national conditions,it is proposed to formulate special legislation on ecological restoration of landfill,establish diversified sources of funds for landfill restoration,clarify legal responsibility for ecological restoration of landfill,establish industry access system,clarity the level and function of restoration standards,and improve the supervision system of ecological restoration oflandfill in order to promote landfill in the new era in China.Sustainable development of ecological restoration of landfill.
