Study On Joint Enforcement Mechanism Of Water Pollution Control Of Across Provincial Administrative Regions

Across administrative water pollution refers to the transfer of water pollutants from one administrative district to another.Due to the liquidity of water pollution,the division of administrative areas and geographical differences,water resources conflicts between different administrative regions are serious.Promote cooperation and law enforcement between provincial governments in the basin,can improve the effect of water pollution control across administrative regions.Water pollution control across cities and counties is under the leadership of the same provincial government,so it is easy to coordinate.Seven major river basins flow through 30 provincial governments,and water pollution disputes between provincial governments occur frequently.Focus on the joint law enforcement mechanism for water pollution control across provincial administrative regions,which will help solve the current law enforcement problems.After the institutional reform of the State Council of 2018,the functions of partition of water areas,sewage disposal and water environmental protection of the Ministry of Water Resources have been transferred to the newly established Ministry of Ecology and Environment.It plays a certain role of "gathering" and "deleting overlap",but there is still a big gap from the requirements for comprehensive governance of water pollution.The Pearl River Delta,the Yangtze River Delta,and the Beijing-Tianjin-Hebei region have taken action against across provincial environmental pollution control by establishing joint law enforcement teams,organizing meetings,signing cooperation agreements,and sharing information.However,the joint law enforcement of water pollution control in across provincial administrative regions,still has problems such as lack of legal basis,imperfect organizational structure,imperfect sharing mechanism and imperfect liability mechanism.The Rhine River is an international river that flows through many countries,and the Tennessee River is a domestic river that spans multiple state goverrnments.Their mature and perfect governance practices provide experience for improving water pollution control in China's across provincial administrative regions.Based on the experience of the Rhine River and the Tennessee River,combined with China's national conditions,it puts forward suggestions for improving the joint law enforcement mechanism for water pollution control in across provincial administrative regions:First,improve the legal system,provide legal protection for joint law enforcement,and strengthen the standard of responsibility,supervision,and accountability procedures for joint law enforcement;provide support in staffing,funding,technology,and authority allocation.Second,establish a normalized joint law enforcement agency to regulate the distribution and operation of responsibilities in the joint law enforcement process.Third,improve the content and procedures ofjoint law enforcement.Fourth,build an environmental data sharing platform,and share it in environmental infrastructure and environmental monitoring technologies.
