Study On Environmental Obligations Of Enterprise

The concentrated and large-scale production and operation of enterprises is one of the main causes of environmental pollution,followed by the pressure and damage brought to the environment by the rapid growth of population.Enterprises attach importance to environmental protection and actively fulfill environmental obligations,which is the key to solve the current environmental problems.Environmental laws of all countries in the world have gradually formed a sound legal system,which plays an irreplaceable role in environmental protection.However,China's existing environmental law system and government regulatory mechanism are far from meeting the needs of dealing with severe environmental problems.This paper focuses on the hot issue of environmental protection in China and analyzes the current situation of enterprises' fulfillment of environmental obligations and the adjustment mechanism of environmental law.The first chapter introduces the background of this paper and the significance of the research,and summarizes the relevant research on enterprise environmental obligations by domestic and foreign scholars.Chapter two defines the relevant concepts of enterprise environmental obligations,including the definition of enterprise environmental obligations,the difference and connection between enterprise environmental obligations and enterprise environmental responsibilities,and enterprise environmental rights.At the same time,it discusses the legitimacy,coerciveness and passivity of environmental obligations.The third chapter introduces the main point of this paper,that is,our country's environmental law should adjust the relationship of environmental law with the mode of "environmental obligation barycenter mode".This paper compares the differences between "environmental responsibility barycenter mode" and "environmental rights barycenter mode",and analyzes the advantages of "environmental obligation barycenter mode".The fourth chapter analyzes the currentsituation of enterprises' fulfillment of environmental obligations under the framework of environmental law in China,and puts forward effective ways to expand enterprises' fulfillment of environmental obligations based on the discussion in the first two chapters.The main point of this paper is that China's environmental legislation and law enforcement should pay more attention to the establishment and implementation of "environmental obligations",so that environmental law can promote the government,enterprises,the public and other subjects to form a benign interactive mechanism,better deal with the severe situation of environmental pollution,and promote the harmonious development of the environment,economy and society.
