Research On China's Environmental Pollution Infringement System

People's original way of life was brought into the modern era by the industrial revolution,and advanced ways of productivity promoted the rapid development of science and technology.The development achievements of the society in recent centuries have greatly exceeded the sum of the past few hundred years or even thousands of years.However,while enjoying these advanced results,we have to bear the negative impact.In recent years,China's economy has developed by leaps and bounds,but the environmental pollution and environmental damage that followed have become more and more serious,leading to an increase in environmental infringement disputes caused by environmental pollution and destruction.These incidents not only bring a lot of losses to the people and property of the people,but also greatly damage the natural resources and ecological environment of the relevant areas,and seriously threaten the survival and development of human beings.As a developing country,China is now facing a serious task of protecting the environment and developing the economy.Therefore,the research on the environmental tort liability system has practical and practical significance.The power of law requires the guarantee of the system,and the establishment and improvement of the system of environmental tort liability is a necessary condition for realizing the environmental rights.Improving the environmental tort liability system is the focus of this article.In addition to the introduction and conclusion,this paper is divided into four chapters,using a step-by-step research method to conduct an in-depth analysis of China's environmental tort liability system.In the first chapter,through the analysis of the related environmental rights,environmental infringement,and the principle of imputation principle,the principle of fault liability and the principle of no-fault liability are studied.The second chapter analyzes the current situation of China's environmental tort liability system,and explains the current environmental tort liability system in China from the aspects of constitutional elements and exemptions.The third chapter analyzes the environmental tort liability system of Japan,Germany,Britain,the United States and France,and proposes that we should stand on the basis of China's national conditions,learn from and refer to foreign experience in environmental tort liability system,and improve China's environmental tort liability system.On the basis of the previous analysis,the fourth chapter proposes various aspects to improve China's environmental tort liability system.
