The Study On Public Health Rights In The Field Of Environmental Law

The right to health is a fundamental human right and a natural right,which is the basic well-being enjoyed by the public.The right to health includes individual health right and public health rights.The public health rights depends on individual health rights,individual health rights is the basis of public health rights,and we can not talk about public health rights without individual health rights,but public health rights transcend individual health rights,having higher environmental standards.Environmental pollution and ecological damage deprivate and limit the right to health which the public should enjoy,and solving environmental pollution,ecological damage,relief of public health rights have become the country's bounden and duty because of environmental public property attributes.The state needs to fulfill its obligations to meet the public's demands for health rights and to safeguard the basic well-being of citizens.Of course,the ultimate realization of public health rights requires the state to fulfill its obligations and the cooperation of enterprises and society.This article mainly uses the method of normative analysis and benefit analysis to describe that the environmental protection and the maintenance of public health are the bounden duty and obligation of the state and the government.It is the way that the basic welfare of citizens can be realized,and this obligation can not be transferred and be shirked.The article is divided into five parts,the first part is an overview of the public health right,mainly related to the concept of the right to health,the right to health and other rights,and the relationship between environmental protection and public health rights;the second part elaborates the theoretical basis of the public health right and provides the theoretical basis for the study of the public health right;the third part is the concrete content of the protection of public health right in the field of environmental law;the fourth and fifth part is the focus of the article,mainly talking about the lack of the protection of public health right in the field of environmental law,and put forward countermeasures to ensure that the basic welfare of citizens can be achieved,so that the needs of public health rights can be protected from deprivation and restrictions.It is hoped that we can make the concept of public health throughout the environmental law field,change the past idea of only considering the environment,expand the ways of relief,and ultimately achieve sustainable development,through the discussion of this article.
