Study On The Legal Problems Of Ecotourism In China

Based on the practical analysis and normative analysis as the main research methods,to the Qinling Mountains mountains and Wudang Mountains area eco tourism legal practice as an example,the basic connotation,focuses on the status of ecological tourism and ecological tourism legislation practice,eco-tourism law finally put forward the countermeasures to improve China's ecological tourism law.The full text is divided into five parts,which are divided into the following:The first part introduces the theoretical origin of the ecotourism law and the basic connotation of the ecotourism law.It is concluded that the basic content of ecotourism law covers many aspects such as eco-tourism legislation,law enforcement and ecotourism management.Under the ecotourism law,tourism will take sustainable development.The second part is normative analysis,and sorts out and analyzes the legislation of all levels of ecotourism in China.It draws the following conclusions:(1)the level of ecotourism legislation is relatively low;(2)the legal operation of ecotourism is poor;(3)the ecotourism legislation pays no attention to "tourism".The third part is the practice analysis.Taking the eco-tourism legal practice in the Northern Piedmont of Qinling Mountains and the Wudang Mountains area as the content,the paper points out that the progress of the eco-tourism legal practice in different places is different,and all of them pay much attention to the protection of the ecological environment.The limitation is embodied in,first,the content of "ecology"and "tourism" in the laws and regulations is not balanced.Second,the integration of"ecological elements" and "tourism elements" is not enough.Third,the concept of"ecotourism" was not formally proposed.Next analyses the deep-seated problems of ecotourism in China first,the lack of "ecological protection" and "tourism development" concept of the fusion concept;second,the legislation of "ecological legislation" and "tourism law" did not achieve the organic unity;third,the legal system,"the special legal system of ecological tourism fourth,lack of ecological tourism;each of the main rights and obligations are not clear.The fourth part is for foreign reference.It mainly introduces the foreign ecotourism management system,public participation system,ecotourism access system,tourist guidance management system,ecological environment education system,ecotourism product development system,main interest balance mechanism,eco tourism planning and so on.The fifth part is the countermeasure analysis,and puts forward the countermeasures to perfect the ecotourism law of our country.First,we should realize that the true eco-tourism should be deeply integrated with tourism.Second,in legislation,we should form a legislative pattern supplemented by local legislation and scenic area legislation based on the basic law of ecotourism.Third,the standard system of ecotourism,the system of ecotourism certification and the system of passenger flow management are stipulated.
