Research On Public Participation Mechanism In Pollutant Discharge Permit

With the development of society,people's economic activities are becoming more and more abundant,but at the same time as economic development,it may have an adverse effect on the environment in which we depend on.Therefore,the international community has gradually reached a consensus on environmental protection.Various countries and regions have begun to clarify the importance of environmental protection in laws and regulations,and through the establishment of various environmental protection systems to regulate the economic behavior that may damage the environment,the environmental protection system the more common system is the pollutant discharge permit system.The pollutant discharge permit system is the evidence of pollutant discharge unit according to law,by issuing a pollutant discharge permit,the rights and obligations of the pollutant discharge unit can be defined and the pollutant discharge behavior of the pollutant discharge unit can be regulated.At the same time,the permit is also the basis for supervision and management of the pollutant discharge behavior by the competent environmental protection department.Public participation is an indispensable link in the implementation process of the pollutant discharge permit system.This article will study the public participation mechanism in the pollutant discharge permit.The public participation mechanism in China's pollutant discharge permit has the following deficiencies:First,the laws and regulations for public participation in the pollutant discharge permit are incomplete,and China does not currently have a unified special law to regulate the public participation mechanism in the permit.The lack of it has resulted in the public participation in the emission permitting being practically inoperable,and it is difficult to fundamentally implement public participation.Secondly,the basis for disclosure of information in the pollution permit is mainly the "Regulations on the Openness of the Government of the People's Republic of China".There are still some problems in the disclosure of information in the emissions permit,such as the ineffective implementation of the environmental information disclosure system and the disclosure of the emission permit information.Third,the main body of public participation.It is not clear that there are few ways to participate,and there is no suitable way for the public to express their appeals.Fourth,there is a lack of feedback for public opinions,and there is a lack of effectiveness in internal supervision,which prevents the public's supervisory power from being implemented through effective channels.The emergence of China has fully demonstrated China's emission permits Public participation mechanisms should be improved.Based on the analysis of public participation mechanisms in China's current emissions permit,and combining the experience of other countries and regions represented by the United States.This article will improve the public participation mechanism in the emission permit from the following aspects:First,form a special public participation protection legislation and refine the existing public participation norms.Second,strictly enforce the information disclosure regulations and increase the disclosure of information Strengthen the information disclosure system of corporate pollution permit.Third,it is necessary to clarify the main body of public participation in the pollutant discharge permit,and increase the public participation methods,improve the feedback mechanism related to the emission permit,and perfect the external supervision system.Fourth,Public participation can be strengthened at the stage of total discharge of pollutants to promote public participation in the subsequent stages.
