Environmental Information Disclosure And Citizen’s Right To Know The Environment

Within the legal framework of environmental information disclosure,many judicial cases of environmental rights of citizens have gradually“surfaced”.Citizens’ right to know the environment is achieved by applying for environmental information disclosure.However,in the judicial decision,it can show the lack of disclosure of environmental information and the problems in the process of exercising the right to know the environment.On the one hand,citizens have unclear understanding of the right to know the environment,abuse of rights,misrecognition of the environmental information itself,which results in the inability of their own rights;on the other hand,the administrative agencies,courts,and related laws and regulations have a right to the citizens’ knowledge of the environment.The protection is not sound,resulting in the citizens being prevented from exercising their right to know the environment.This article focuses on the analysis and analysis of the referee documents of environmental information disclosure cases and conducts research on the current situation of citizens’ right to know the environment.It is divided into four parts:The first part mainly deals with the statistical arrangement of environmental information disclosure cases.Separately conduct statistics on the number of environmental information disclosure cases and the proportion of each judgment,so as to have a more detailed grasp of environmental information disclosure cases,and to find the predicament in the process of exercising the right to know about the environment.The second part is a case study of citizens’ improper exercise of the right to know the environment.Citizens have different reasons for improperly exercising the right to know the environment,and they have different manifestations in the judgment documents.For different reasons,corresponding countermeasures and measures can be put forward for regulation,which can provide practical basis for improving the exercise of environmental right to know.The third part is the analysis of the case of insufficient protection of the right to know the environment.This article starts from the different subjects such as administrative agencies,courts,and related laws and regulations,and analyzes thesituations in which different entities have insufficient guarantees or imperfections in protecting the right to know the environment.This can be used to regulate different subjects through different means to protect citizens’ right to know the environment.The fourth part is to protect citizens’ right to know the environment in environmental information disclosure cases.Through the problems shown in the ruling documents,suggestions are made in legislation,administrative enforcement and judicial trials to standardize the procedures and contents of environmental information disclosure.
