Study Of National Park System Structure From Legal Perspective

Currently China already has 10 pilots national parks,which opens an important window for China’s sustainable development and ecology construction,which also is a significant step taken to protect the environment.In international level,the primary values of the national park are preservation and enjoyment.However each country put different emphasis on these two values.For example,preservation and enjoyment are also the most important values of U.S.national park,but the preferential order between them is not defined by law.In Spain,preservation is the only primary value of the national park.The idea of national park is brought up to cope with the serious environment condition in China,so preservation is the primary mission undertaken by national parks.The enjoyment of the people should be enlarged only when the protection is effectively fulfilled.The construction of our national park system is in the form of pilot.Comparing to the system and legislation,we still have shortcomings,such as the unclear criteria of national parks admission,the unclear administration authority,the lack of zoning protection system and the insufficiency of public participation.Therefore this article will discuss the above mentioned issues and combine with the experience of foreign countries in order to come up with improvement advice.
