The environmental risk issue has become a hot issue in today's society,and people's concerns about environmental risks are increasing.However,as far as the current research status is concerned,environmental risks have formed relatively rich research results in the areas of environmental management and environmental science.Only in the legal aspect,environmental risk research has not yet formed a more mature theoretical system.Therefore,it is of great theoretical and practical significance to take the environmental risk prevention principle as the basic principle of environmental law.This paper starts from the development of environmental risk principles,makes a thorough analysis of the principle of risk prevention from the perspectives of foreign legislation and other aspects,and makes an effective study of the principle's established feasibility in China.The first part of this article clearly identifies environmental risks in the legal sense,describes the characteristics of environmental risks and the need to prevent environmental risks,compares the different principles of risk prevention and prevention first and makes an in-depth analysis of the thresholds for determining environmental risks.The second part analyzes the institutional manifestation of environmental risk prevention principles in the international community to provide legislative reference for the construction of China's environmental risk prevention system.The third part expounds the application and construction issues of the principle of environmental risk prevention in China's environmental law.It pointed out the problems of our country's current environmental risk prevention system and proposed feasible solutions.The fourth part elaborates the establishment of the legal system that is compatible with the principle of environmental risk prevention.It has explored the establishment of relevant safeguard systems for environmental risk prevention principles,such as environmental accountability mechanisms and environmental risk information disclosure systems.
