| In the 21 st century,as the most extensive ocean on the earth,people pay more attention to it.With the progress of science and technology,the growth of population,the pace of human development of the ocean is faster and faster,and the utilization of marine fishery resources is also higher and higher.As a populous country and a powerful marine country,China has always paid attention to the exploitation and utilization of marine fishery resources.However,the long-term overfishing has led to the gradual decline of marine fishery resources.The high-density and single-species mariculture industry has also adversely affected the marine environment and ecosystem,accelerating the degradation of marine ecosystems and further depletion of marine resources.In this context,with the implementation of sustainable development strategy and the proposal of new development concept,how to promote the sustainable development of marine fishery resources in China has become a key issue.This paper is divided into five parts.The first part is the introduction.It elaborates the background and significance of choosing sustainable development of marine fishery resources as the research object,and briefly summarizes the research results of domestic and foreign scholars on sustainable development of marine fishery resources.The second part combines the knowledge of ecology and oceanography to analyze the connotation and extension of marine fishery resources,and elaborates the theoretical basis involved in this study and the development process of marine fishery resources and legal system in different historical periods in China.The third part summarizes the shortcomings of the legal system in the process of marine fishery resources management according to the current situation of marine resources utilization,including five aspects: inadequate basic legislation,unscientific fishery resources supervision and management system,lack of safeguard mechanism,inadequate guidance legal mechanism and imperfect legal liability.The fourth part tries to study the legal systems of Japan,Korea and the United States concerning thesustainable development of marine fishery resources,and summarizes the useful experience,so as to provide a mirror for the improvement of the sustainable development system of marine fishery resources in China.The fifth part is based on China’s basic national conditions,and in view of the defects of the legal system analyzed in the third part,it puts forward one by one the solutions to improve the basic legislation,improve the fishery resources supervision and management system,establish the safeguard mechanism,improve the legal guidance mechanism and improve the legal liability. |
