Research On The Case System Of Environmental Resources Cases Under The Background Of Specialization Of Environmental Justice

In recent years,the continuous development of the specialization of environmental justice has led to more and more challenges in the trial of environmental resources cases,the first of which is the cause system of environmental resources cases.In the traditional case classification system,environmental resources cases are hardly involved,and the first problem to be solved in the development of environmental judicial specialization is the classification of case causes.Through the introduction of the case classification system and the case classification system of environmental resources cases,combined with the relevant provisions on the scope of environmental resources cases in several provinces and municipalities represented by Yunnan Province and Chongqing City in China.It concludes that there are many problems in the system practice of environmental resources cases in China,such as the narrow definition of the scope of environmental resources cases,the blank of new types of environmental resources cases,and the disorder of environmental resources cases.Therefore,in order to ensure the smooth development of the specialization process of environmental justice in China,we should redefine the classification criteria of environmental resources cases on the basis of accurately distinguishing the particularity of ecological legal interests from that of traditional legal interests,and construct the cases of environmental pollution prevention and control,ecological protection,natural resources development and utilization,climate change response and ecology.The new system of environmental resources cases is represented by the case of environmental damage compensation and the case of energy conservation,development,utilization and protection.
