Research On The Conflict Between Genetic Use Restrictions Technology And Farmer's Right To Save Seeds

The most controversial application of plant genetic engineering may be genetic use restriction technology,which causes growers have no way to sow the seeds they saved again,and have to keep buying new seeds from seed producers,thus grainelier's rights are protected fundamentally.The application of the technology has broken the agriculture law that most farmers in the world are used to saving seeds for thousand years,and hurts the growers' interests at some level.How to solve the conflict between them efficiently in order to promote the harmonious development of transgenic plant variety,is now a hard problem that scientists,ethicists,politicians and sociologists confront.This dissertation analyzes the traditional custom for farmers to save seeds and the generation of genetic use restriction technology,discusses the emergence of the conflict between the patent protection for breeders and the right for farmers to save seeds,dissects the underlying reasons,proposes the suggestions for conflict resolution based on satisfying both sides' interests as far as best.The dissertation consists of four chapters following the introduction.The introduction mainly describes on the background and importance of the study,the research status and the content at home and abroad.The first chapter introduces features of the traditional agriculture and the custom for farmers to save seeds,focusing on the protection of the right to save seeds in the modern society.The second chapter introduces not only the generation and the application of genetic use restriction technology,but also discusses the ethical conflict due to the technical protection for innovation and genetic use restriction technology by taking Monsanto Company as a case.The third chapter analyzes the genetic use restriction technology's technical protection measures for innovation,the deprivation and impact for farmers' right to save seeds,dissects the underlying reasons of the conflict.The fourth chapter proposes the suggestions for conflict resolution,mainly under the premise of balancing both sides' interests.
