Research On The Problems And Governance Countermeasures Of Illegal Buildings In Zhejiang

With economy and society rapidly developing and urbanization fiercely advancing in Zhejiang Province,mass Illegal buildings has come into being and run out of control.Illegal buildings has become a negative contributor to economic and social development due to its great social harmfulness such as damaging human residential environment,leading to safety hazards,causing spur contradictions and disputes,hindering urban and rural construction,affecting transformation and upgrading,and undermining fairness and justice.For the safeguard of public interests,the maintenance of social order and the guarantee of sustainable,healthy socioeconomic development,it is of great significance to fully analyze the causes of Illegal buildings and systematically put forward governance principles and countermeasures.This paper deeply analyzes the causes of Illegal buildings at the level of individual,government and society.At the level of individual,individuals have a strong subconscious desire to be illegal driven by the high yield of Illegal buildings and a strong need for illegal buildings.At the level of government,there are more complicated causes.According to the analysis based on market logic,national logic and bureaucratic logic,the local government may take the initiative to execute,shelter and wink at Illegal buildings during a particular historical period;the short supply of public services in both urban and rural areas contributes to the construction of illegal buildings for meeting basic housing needs;the imperfect administrative law enforcement,limited means,poor efficiency,low fairness and insufficient authority reduce the punishment against illegal building owners;the improper spatial control of land and planning promotes the construction of resistant and ―rational but illegal‖ buildings.The social causes include the insufficient participation of the public and primary self-governed mass organizations,the deviation of public opinion guidance,and absence of effective social governance.Based on an analysis of the present situation and causes of Illegal buildings in Zhejiang Province,as well as recent practical experience of intensive governance over Illegal buildings,this paper puts forward governance principles including legal governance,normal governance,balanced governance and collaborative governance,as well as six specific countermeasures: first,keep down illegal gains,undermine illegal motivations,and impose necessary restrictions and punishments on Illegal buildings in terms of production and operation,real estate registration,financing,public service and credit,to cushion the profit margins;second,strengthen supervision and punishment,crack down on the government’s illegal acts,and promote the local government,as well as the officials,to change its behaviors by perfecting government performance appraisal,enhance supervision over government behaviors,and boost individual accountability;third,perfect the public services and improve the supply mode,to better meet the urban and rural basic housing needs;fourth,consummate the enforcement mechanism,intensify the law enforcement efforts,build a more rational enforcement system,increase the enforcement efficiency and intensity,and enrich the ways of law enforcement;fifth,reform the governance system to reduce the acts against legal enforcement,and relax the irrational restrictions on the civil rights from spatial regulation;sixth,guide multiparty participation,boost social governance,and encourage and guide the public,primary organizations,various social organizations and enterprises to participate in Illegal buildings governance,to form a good atmosphere of social co-governance based on the public opinions.
