The Development Trend Of International Investment Rules And China's Response

After the world economic crisis in 2008,the developed countries and developing countries have changed their strength,and the pattern of world investment has also changed.Changes in the global economic structure will inevitably lead to the adjustment of global economic and trade rules.In the area of international investment,the present situation of the international investment agreements,by the end of 2015,is that the number in the world on investment agreement has reached 3304.The international investment rules system has shown the "spaghetti bowl" effect which means international investment agreements overlaps with each other.Therefore,whether subjective or objective,international investment agreements need to change.Currently,it is in the period of strategic opportunity of adjustment of international investment rules.Based on the history of the development of international investment rules,this paper summarizes the inherent laws and predicts the development trend in the process of analyzing its evolution.And using the theory of international mechanism and game theory,this paper explores the principles of invariance that should be followed in constructing international investment rules.On this basis,it provides a theoretical reference for China to better participate in the reconstruction of international investment rules.The first chapter introduces the research background,purpose and literature of international investment rules at home and abroad,and points out the innovation and shortcomings of this paper.The second chapter is a summary of the theory of international investment rules,that is,the theory of international mechanism.The third chapter describes the emergence,development and internal contradictions of international investment rules.The fourth chapter analyzes the reasons for the emergence of new changes of international investment rules,and then studies the essence of the new changes of international investment rules by using international mechanism theory.Finally,on the basis of the above analysis,the next development trend and direction of the international investment rules are predicted.The fifth chapter is about the impact of the new changes in international investment rules on China,and the measures China needs to take.From the perspective of game theory,this chapter shows the first advantage of actively participating in the negotiation of new international rules.Then it points out the challenges and opportunities China actively participating in the reconstruction of international rules.At length the paper gives the measures and tactics China should take in the important strategic period.
