Research On The Reason Of China Frequently Being Applied AFA Rule

In recent years,China was excessive abused with "adverse facts available" rules(the rules of AFA),which as a means of investigation and ruling,in the countervailing duty cases of Unites States.It is also one of the main reasons for China's extremely high countervailing duty rate.The purpose of this paper is through countervailing duty cases reports to summary and disposal information of the application of adverse facts available rules.Through compare of deep meaning,history,and reason-ability of AFA rule and FA rule,this article explore the cause of China's frequent AFA rule from the subsidy program,enterprises and government behavior aspects involved further.The results of this research as following:The program of less than Adequate Remuneration countervailing duties is the highest,especially less than adequate remuneration for the raw material;and the program of government grants is the most widely and various.The more enterprises and government cooperate with investigation,the less use of AFA rule.Noncooperation will get a punishment of the high anti-subsidy duty.High cost of litigation,the enterprises insufficient understanding for the severity of the damage to trade,Chinese companies cannot cope with frequent countervailing investigation.And the distrust also has a great influence on the companies involved.Enterprise scale and export.The larger the company scale,the more they will be willing to cooperate;the more exports,the more they will be willing to cooperation.Based on those findings,then it put forwards suggestions on the government,enterprise dealing with AFA rule...
