After the founding of People's Republic of China,it's rural land ownership has undergone many changes. It was the result of the interaction of political, economic, social and cultural factors at the same time, and also had a significant impact on the agricultural production and peasantlife in different periods. The paper mainly studied the evolution of rural land system, taking the rural land ownership as the starting point, and tried to explain the relationship between the national behavior, the rural land ownership and the farmers' land rights.China's rural land ownership changes could be divided into three stages. The first stage was from the founding of new China to the initial establishment of the basic system of socialism in 1956,during which the rural land ownership wasowned by the peasant; The second stage was from 1956 to 1978 before the convening of the Third Plenary Sessionof the 11 th Central Committee,This period of rural land ownershipwas the collective form of land; The third stage was since 1978 so far, this period of rural land ownership was still land collectively, but different from before 1978.In the first two stages, the focus of our study was on the impact of state behavior on rural land ownership and the impact of rural land ownership on farmers' land rights. After 1978,we put our attention on the state's policy on farmers' land rights, and on the state's protection of farmers' land rights at the legal level. Most importantly,we researched the farmers were given the land rights,at the same time, also explored how the acquisition of land rights affected the development of rural land system step by step in turn, and how it affected the country's decision-making.Since the founding of new China, the land rights of peasants changed with the change of rural land ownership, showing a rising trend on the whole, but the shortage of land system in different degrees influenced the development of farmers' land rights. It was imperative to take effective measures to legally protect the farmers' land rights.
