Research On The Supervision Of Individual Operation Endowment Institution

China has entered an aging society,endowment institutions;especially individual operation organizations have an indispensable role in the support demand about the aging people,disability elderly,mentally handicapped elderly and other elderly groups.However,in recent years,the frequent occurrence of various types of vicious incidents declare that there were many loopholes on the supervision of individual operation organizations,it's not only infringed the legitimate rights and interests of the elderly but also limited the development of individual operation endowment institution.This paper first defines the concept and property of individual operation endowment institution,cards the existing legal system of individual operation endowment institution,introduces the current development and supervision of individual operation endowment institution;on the basis of these theories,combine with case studies,analyze some problems in the supervision of individual operation endowment institution.Such as lacking of legal protection,government having regulatory integration but lacking of social supervision,the dual supervision of for-profit and non-profit individual operation institution inhibiting the enthusiasm of social investment,regulatory focus on the post-punishment rather than pre-prevention,incentive policy is not on the point,lacking of information technology supervision and so on.The reasons for those series of regulatory issues are multifaceted.From the perspectives of public power,mainly including the means of governing country is"policy-based",the government frame of governing and supervision lacks of perfection or responsibility,the lack of classification management and evaluation system,government supervision concept is not advanced,the policies to support the development of individual operation endowment institution is imperfections.From the perspectives of individual operation endowment institution,there are lack of operating funds,management and service concept is obsolete,imperfect management system and the initial location is unreasonable,the elderly and their families legal awareness is weak.From the perspectives of social support,there are some unfavorable factors in the development of individual operation endowment institution,such as the traditional filial piety,the community's prejudice on the individual operation organization and their care workers,the lack of ownership awareness.Combined with international advanced experience,China should complete the legal system,improve the operability of the law,establish government supervision and coordination mechanism as soon as possible.In the aspect of government regulation,it should give the civil authorities the absolute power in the supervision of individual operation pension institutions,and all departments work together,also focus on the establishment of regulatory mechanisms for regulators.The nature of individual operation endowment institution should be properly positioned,government incentives need to be based on a complete system.At the same time,government should abandon the backward regulatory concept,use a complete regulatory concept to govern the individual operation endowment institution.In addition to innovation and implementation of financing policies,land policy,talent policy,and establish national long-term care insurance system as soon as possible.Meanwhile,increase the publicity propaganda,encourage volunteer service,make institutions and the elderly have long-term effective contact and interaction with the outside world.
