Study On The Discretionary Power Of Administrative Punishment For Entry And Exit Border Inspections

The administrative discretion is an important power endowed by the law to the administrative organs at all levels.Whether it can be exercised within the scope permitted by law,and whether it can really exercise power effectively and reasonably,is related to the vital interests of the administrative counterpart.The Exit-Entry frontier inspection authorities as a police of public security organs,with the administrative law enforcement and punishment,is the port law enforcement agencies exercise discretion for administrative penalty of concrete.In the concrete implementation,whether it can exercise effectively and truly realize the functions of the modern government is an important issue.This paper analyzes the problems existing in the practice of law enforcement in the administrative penalty of Exit-Entry frontier inspection,and puts forward some suggestions on controlling and regulating the use of discretion.This paper is divided into four parts,the first part mainly expounds the basic meaning and the Exit-Entry frontier inspection administrative penalty discretion characteristics;the second part expounds the theoretical basis,value,principles and standards;The third part,taking the discretion of administrative penalty in Exit-Entry frontier inspection station as an example,expounds the forms of analyzing the discretion,points out the problems existing in the practice of law enforcement,and analyzes the causes;the fourth part is used to control and regulate the frontier inspection administrative penalty discretion and puts forward related suggestions.
