Conditional Non-prosecution System Research

With the rapid development of Chinese economy and transportation,the number of cases of misdemeanors across the country has also greatly improved,and the work pressure on the courts and prosecutors has also increased.In order to save judicial resources to a certain extent,at the same time,in order to give those who commit a specific misdemeanor case a chance to make new rehabilitation,conditional non-prosecution is written into Chinese legislation after years of extensive trials.Therefore,it has unique practical significance to establish the conditional non-prosecution.Its establishment has further improved the original non-prosecution system in China,and in a certain sense has promoted the harmony and stability of Chinese social environment.However,China is not the first country to create this system.It has been stipulated in some countries and regions around the world.Therefore,the establishment of this system in 2012 is a major step forward in Chinese criminal procedural legal system.However,the existing regulations are still unable to meet the needs of Chinese judicial practice.There are still many problems that need improvement.Therefore,we should base on the analysis of legislation and practice situation in our country,through using the advanced experience of other countries and regions,and then puts forward some perfecting suggestions for this system.
