Research On The Legal Issues Related To The Construction Of The China-ASEAN Common Market

As the cooperation between China and asean economic become closer,the degree of opening among multilateral sides can not fully meet the needs any more.Trade cooperation field needs to be upgraded.The TPP agreement is established to against China's economic model,and at the opposite of China's developing direction.Thus,joining the TPP is infeasible for China.On the side,the RCEP agreement of asean is not yet mature and needs to be increased.Developing CAFTA as the world common market,may be the third new direction or the new path of China and asean's cooperation.CAFTA can update to be the China and asean common market.Modifing the original legal documents is necessary to establish the China-asean common market,create new legal framework to meet the requires of the economic cooperation.Common market law research is benefit to contribution of the China and asean commom market's system.This article relies on fact that regional economic development and legal enforcement,inspired and learned from other laws,gives suggestion of commom market law.This paper is divided into five parts.The first part is divided into three sections,including meaning of this paper,used method of investigation,innovation of this paper.The first part is an introduction of whole paper.The second part is the first chapter of this papre.This part is tries to clarify the necessity of building CAFTA.This part will discuss the problems with CAFTA arae and international situation,so that to prove the suggestion about establishing commom market.The theoretical basis of this paper include domestic and foreign research summary,which relate to CAFTA research outcome and western common market theory.All thses theories will support for further research of this paper.The third part is the second chapter.Main point of this part is summing up CAFTA legal system,and lead to the problems in CAFTA legal system.On account of problems in large quantity,this paper just chooses three important problems to disscuss.The fourth part,namely the third chapter.This part will put forward the law framework of common market,and give out solutions to problems recommended in the second chapter.EU market law will be a blue print for China-asean common market.And how to coordinate the common market law with rules of the WTO,rules of APEC will also be discussed in this part.Avoiding conflict of law rules among China mainland,Hong Kong SAR?Macao SAR and the Taiwan region is one of the topics of this part as well.Conclusion part is a review conclution of the full paper.This part will look forward to estabblishment of China-asean common market legal system,and wish to increase the China-asean regional integration,to realize the common development and common prosperity.
