Empirical Research On The Optimal Allocation Of Trial Resources

Since recent years with the rapid development of the legal construction of our country,the citizens' consciousness about legal construction is becoming stronger,followed by that more and more citizens choose to resort to lawsuit to solve disputes.As a result,the embarrassing situation “shortage of staffs” has appeared.With the ground in many grass-roots courts the reforming measure of the optimal configuration of trial resource has been taken one by one,but the situation remains severe,especially when the grass-roots courts and judges are shouldering more and more pressure out of control.And this situation is standing in the way of the trial process and even has negative influence on the development of our legal construction.Thus,the author chooses the optimal configuration of trial resource as the research object to discuss how to optimize the limited trial resource,dealing better with the cases that are rushing over and solving the disputes in time.In fact,the optimal configuration of limited resource has been the key subject of economics for long.With the refining of labor division in society,the principles in economics have got involved in deeply every field of the society.Besides,the analytical method of cost & profit has always been regarded as an effective toolTo be used in the economic field.Based on the principles in economics there is no doubt the optimal configuration of trial resource would get involved with a series of problems,including the institutes and organizations of optimal configuration of trial resource,the making of rules of optimal configuration about trial resource,the performance of optimal configuration about trial resource.With the background mentioned as above the author spent one year doing research in grass roots courts of C city and searching for the difficulties in the practice of the optimal configuration of trial resource.Moreover,by combining the lawsuit theory with specific juridical practice to do analysis the author finally got the conclusion and the research achievement.The essay includes 4 parts.The first part is mainly to describe the basic content of our judicial resource trying to figure out the background as a whole of the optimal configuration of trial resource through the analysis on the factors in both internal and external ways that limit the optimal configuration of trial resource from the perspective of the courts reforming,defining the micro factors of optimal configuration of trial resource.In the meanwhile to do analysis on the functional value and make research base for the optimal configuration of trial resource.The second part is focused on the research about the current situation of the optimal configuration of trial resource of the grass-roots courts in C city.The third part is to sort out the limit factors in the practice of the optimal configuration of trial resource.Thefourth part is to think as a whole about the optimal configuration of trial resource based on the analysis about the theoretical background and practice giving specific suggestions.The essay adopts the method in the form of sociology according to the need of realistic problems of the grass-roots courts in C city,leading by the functionalization,emphasizing the combination of theory and practice,seeking for the integrating point of the optimal configuration of trial resource and the current judicial reforming,providing solution to improve the quality of trials.
