I Study The Legal Issues Of The Supervision Of Civil Drones

Civilian UAV has developed striding over centuries from flight trials in its early days to nowadays flourishing progress.It has experienced a lot of technical breakthroughs and achieved great success in its practical application.With the improvement and perfection of relevant scientific and technological level,civilian UAV technology has been widely applied in each filed.However,it needs to be noted that behind the skyrocketing growth there exist many hidden dangers unavailable for detection and handling,such as interference in normal operation of military and civilian aviation,damages to ground crew and properties due to uncontrolled falling,infringement of other people's privacy,and theft of state secrets.But legal norms on regulating civilian UAV are in huge shortage in nowadays China.This article has elaborated damages caused by unordered flight of civilian UAV,and specifically analyzed the influence on civilian aviation safety.This article believes that,consummating legal regulations on civilian UAV supervision is of great significance and positive effect on promoting heathy and prosperous development of civilian UAV industry,maintaining air traffic order,and guaranteeing civilian aviation safety.Effectively standardize civilian UAV subject's relevant behaviors by specific laws and provisions from legal perspective,to clarify whether their behavior operation is in compliance with regulations,and then to delimit their behaviors clearly.In addition,it can be set as important code of conduct to lead the development of civilian UAV industry,including the production and sales of civilian UAV,so as to realize the effective regulation on relevant procedures and positive guidance for civilian UAV related industries.Meanwhile,perfection of relevant regulation construction is critical for establishing and consummating air traffic order.Through effective demarcation of concerning subjects' rights and liabilities can help regulate airspace activities.For those violating state's relevant provisions,severe punishment must be conducted to strengthen airspace security and promote steady and positive development of civilian UAV.Thus each stakeholder's behaviors in civilian UAV industry chain can be standardized to effectively improve operating efficiency of civilian UAV market.Therefore,by combining with relevant laws and regulations targeting at civilian UAV and referring to foreign civilian UAV regulation practice from aspects of legislation,law enforcement and law-abiding,this article has proposed following suggestions: 1.Carry out top-level design and consummate legislative stipulation;2.Clarify subject of law enforcement and strengthen law enforcement force;3.Standardize enforcement procedure and intensify law enforcement tools;4.Establish army and civilian linkage and military and civilian synergetic UAV supervision mechanism;5.Strengthen publicity and education of laws and regulations and establish authority of laws and regulations.In addition,formulate different management measurements based on different types of civilian UAV.While regulating the management and development of civilian UAV,its benefited parties' rights and interests should be guaranteed validly,on the basis of China's baseline development conditions to realize effective construction of aviation related laws and regulations.
