In recent years,as the expansion urban construction land and rural collective land being expropriated to state-owned land gradually increased,the rural collective owned organizations or individuals can not have the same right as the organizations and individuals who have the right on state-owned lands and buildings,at the same time,the administrative planning is not scientific,democratic phenomenon was destoryed,land management law and its supporting regulations can not adjusted the law relatioships caused by land,it also leads to a result of the discoordination with the urban and rural planning law.in the process of exercise of public power,the administrative organs caused by the highlighted contradictions during identificating and treatmenting on illegal buildings,it leads the government lost credibility,At here,the author only discuss the legal problems of buildings on collective lands that located in city planning areas and village planning areas.In this paper,I will discuss the ownership of illegal buildings on the collective land,the identification of illegal buildings,the classification of illegal buildings,the government expropriation compensation,the administrative planning,the adminsrative and relief of the administrative counterpart.the core problem is the identification and treatment of illegal buildings on collectively owned land.As the rapid development in today’s Internet era,"Internet +" is leading a new era of social development.In order to avoid unnecessary conflicts between officials and the public,the government should make full use of network resources,establish information sharing mechanism,monitor and report mechanism.The law enforcement departments of the government shall intensify the study of laws,regulations and rules,so as to avoid substantive and procedural illegality in the process of law enforcement.
