According to the theory of state responsibility,country has duty to prevent crime and protect citizens from criminal responsibility.Because the crime can not be fully prevented,therefore when the victims and their relatives in the absence of compensation for the perpetrators,the state should be given specific and effective economic compensation to compensate the victims of economic losses.The state compensation system for criminal victims must establish procedural safeguards for them and make normative stipulations.In accordance with the state compensation in the conditions of the victim in the court within two years to receive criminal cases within the jurisdiction of the establishment of the court of criminal victims within the National Compensation Commission for national compensation.The Review Committee shall be composed of three or more judges.The review committee adopts the principle of "written examination as the principle,and the organization hearing as the exception" as the examination mode,and makes the decision according to the principle of "minority submits majority".The decision shall take effect immediately upon its making.At the same time,the state compensation system should also set up a system of compensation,compensation,repayment and recovery of state compensation cases.
