Research On The Lake Protection Legislation System In Yunnan Province

Lakes are not only an important part of the geographical environment,but also play an irreplaceable role in agricultural irrigation,shipping traffic,water supply,and maintaining ecological balance.There are more than 40 lakes in the Yunnan province,with an sum of area about 1,100 square kilometers,accounting for 0.28%of the province's area.Among them,there are nine lakes with a sum of area more than 30 square kilometers,which are Dianchi Lake,Erhai Lake,Fuxian Lake,Xingyun Lake,Qilu Lake,Chenghai,Lugu Lake,Yangzonghai Lacke,Yilonghu Lake.Those lakes and some other small lakes are distributed all over the country.Both of them have provided a guarantee for the province's rapid economic development.However,with the continuous development of social economy in our province,the lakes begin to appear water atrophy,ecological function decline,eutrophication of water bodies and other issues.Although Yunnan province in the early years has been prepared for the "one lake one model" of the lakes resources for legislative protection by nine plateau lakes' characteristics of its own.But there are also many problems in practice,such as the lack of fine degree of legislation,the over-regulation of regulations and the imperfection of the legal system,have caused the disorder of the law enforcement system and the unclear boundaries of the powers and responsibilities.All these matters caused the failure of the initial lakes protection's objectives.In March,2015,the new Legislative Law of the P.R.C has been amended.This new law is to delegate the local legislative power of environmental protection from the provincial people's congress and its standing committee to the municipal people's congress and its standing committee.The decentralization of local legislative power in the local environment has responded to a great deal of demands of local legal system construction.It can indeed mobilize the initiative of local legislation on the basis of standardizing local legislation so as to create more local environmental legislation.However,because this change is also too difficult to achieve the expected purpose and may cause the local protectionism more obvious,and these will finally bring greater challenge to local environmental legislation.Among them,this article are ready to start from the perspective of legislative system.Through the analysis of the status quo of lakes protection's legislation in our province,draw lessons especially from Jiangsu and Hubei's lakes protection's legislation,set up and improve the local legislation system of lakes protection in our province,and focus on the systematic of lakes protection's legislation.To ensure the harmony of the lakes protection's legislation,so as to reach its function maximization,save the legislative resources and finally realize the systematic legislation of lakes protection in our province.
