| Red culture is the concentrated expression of red resources,red traditions and red genes,including the red resources and red spirit since the May 4th Movement or the new democratic period,and the advanced socialist culture formed after the establishment of the socialist system.Since the 18 th National Congress of the Communist Party of China,legislative protection of red culture has been strengthened across the country.Although national and some local legislation has issued some relevant provisions to protect red culture,there are still many problems in the legislative protection of red culture.In this paper,based on our country present local rules and regulations of the red culture protection text analysis,summarizes the successful experience of red culture protect local legislation throughout,extracting red culture around the protection of local legislation needs to solve common problems,puts forward specific Suggestions on perfecting the local legislation,to further enrich the research of red culture protect local legislation in our country,It also provides theoretical support for future related legislation.To protect and inherit the red culture and promote the spirit of red culture.This study adopts empirical analysis method,value analysis method and other methods,takes the current situation,problems and suggestions as the main context,selects the current effective local legislative texts of red culture protection,including local regulations,local government regulations and normative documents for analysis,and comprehensively summarizes the current status of local legislation of red culture in China.The analysis of local legislative texts of red culture protection reflects that the number of local legislative texts of red culture protection in China is low and the process is slow,which can not meet the protection needs of large number and wide distribution of red resources.The local legislative text is not precise enough for the protection of red culture,and the responsibility of the protection subject,the establishment of special funds and legal responsibility are not clear.The irregular arrangement of legislative name and style.In order to improve the quality of local legislation for the protection of red culture,this study puts forward that the legislative process should be accelerated,and the local characteristics should be reflected while harmonizing with the upper law.Improve the refinement of legislation to improve the legislative content,the meaning of red culture should be further clarified,the system of responsible persons for protection and legal responsibility should be clarified;Improve legislative technology,standardize legislative title and arrange text structure rationally,and use new media as a new way to publicize and supervise the protection of red culture;It evaluated the legislation,established the multi-responsible person protection mechanism,put forward suggestions for improving the local legislative protection of red culture,and also provided reference for the later legislative work,making the local legislative text more scientific,and providing legal normative support for inheriting and protecting the red gene and flourishing cultural undertakings. |
