Abstract/Summary:
The problems of the jurisprudential ontology have long been forgotten in legal research. Firstly, the author brings up the meaning and value from researching the ontological problems through investigating etymology of ontology. The next in order, the author clarify the misunderstanding of "evil law is no law"from exploring the natural law in the way of ontology. The next but one, the author make a further explanation of the jurisprudential reality from the historical development of natural law. The next but two, the author analyzes the jurisprudential reality from the perspective of legal positivism and natural law. To the end of the chapter, the author combine the Xi’s chinese dreams with the natural law and legal positivism. The author belives the Chinese dreams is’rule by law’.If the ’rule by law’ goes into practice with the principle of nature law. The chinese dreams will be the true dream but not the false one. Our’rule by law’would make a great progress.
