As the society develops, living standard of people becomes much higher. In restaurants, they have the chance to taste some delicious food throughout the country or even the world. In various parts of China, fish filets in hot chili oil of Si Chuan and cold noodle of Shan Xi turn into a kind of favorite food of different people, who come from different hierarchies and ages. Among them the most important vegetable is bean sprout, whose security issues have recently become a focus that the society concerned. It has been a long time since the discussion of bean sprout‘s manufacture and production appeared into people's eyes. When searching the key words “bean sprout, crime of poisonous and harmful food” only under the Net of Chinese Judgment Document that belonged to the supreme people's court, it can find that there are 709 related cases and 918 people have been punished altogether from January 1, 2014 to February 1, 2016. As a matter of fact, these figures are still continued to rise. The thesis expects to carry a research on the judgment about some cases of poisonous bean sprout that made by people's courts at various levels in recently years. It mainly probes into the fact whether the rootless water remained on poisonous bean sprout is harmful to people and how to judge such cases that involved in poisonous bean sprout. The thesis analyzes the case of bean sprouts farmer Quan Shanggen in Fu Jian Province to explore some issues that should be completed on the food safety legislation in Chian.
