Research On The List System Of Local Government Power

The administrative power list system is the product of deepening of the reform of administrative system,the new exploration of effective restriction and supervision to the government from our part and the new experiment to advance modernization in the State governance system and governance capability.The Third and Fourth Plenary Session of the Eighteen both decided to implement the administrative power list system to expose the power in sunshine and accept diversified supervision.The administrative power list system is to count the number?the type?the procedure?the condition?the department and the boundary of the power and publish it to the public with a list,making the government and the department ues the power by the list and accept supervision consciously.Accurately defining the administrative power list system is the key to push the system smoothly.The administrative power list is the information which is proactively published by the government and accept supervison.It can't be above law.When the administrative power list conflicts with law,we should obey the law.The system makes sense to prevent the abuse of administrative power,guarantee civil rights and build the legal government and society.At the same time,it also promotes the govenment transformation,balances the relationship between govenment and market and increases the market vitality.At present,the administrative power list system has aroused wide concern and the government and department are implementing the system positively.By 5 February 2016,all the 31 provincial government departments have all finished the formulation of the lists and put them into practice.The municipal and county-level governments participate in the system more positively.As a new system,the administrative power list system meets some problems.On content,the standard of the power is not unified and the power is not counted completely which provides the basis for the government to limit himself.On procedure,the administrative power list system is lack of a strict and unified procedure to build the list.On the supervision and accountbility,the administrative power list system is lack of supervision and responsibility machanism accordingly.The development process of anything can not be plain sailing,so does the administrative power list system.It can only go ahead and find the solution to the problems from reality.This paper provides some solutions to them.Firstly,make typed management to the administrative power to optimize the content of the list.Secondly,establish a strict and unified procedure for building the list.Thirdly,establish responsibility machanism for system accordingly.Fouthly,establish supervision machanism for the system accordingly.
