In recent years, the reformations of china's rural land policy accelerate. N0 I central document 2014 on deepening the comprehensive rural reform, accelerating the modernization of agriculture a number of opinions set the aim of the agricultural development for the subsequently period. The No I central document imposes right to the contracted management of land mortgage for the farmers. The land ownership, the right to contract and the right to operate should be separated. Our government will stick to the basis of collective ownership of rural land, stabilize the rural land contract management system, and allow the contracted management of land mortgage for financing. This is undoubtedly an important measure to promote the reform of rural land market. By allowing mortgage of the right to contracted management of rural land which is the main family property of famers may arouse the huge amount of capital for the countryside and brings great chance to the development of agricultural modernization and rural financing. According to the Chongqing's rural property mortgage financing, this article object on how to build a legal system of the right to the contracted management of rural land mortgage to promote rural financing and push forward the building of new socialist countryside, trying to solve the rural and agricultural economic development problem—rural development fund shortage.The first chapter is about the feasibility of the right to the contracted management of land mortgage. Describe the connotation of the right to the contracted management of land mortgage parsing, the theoretical principle of the feasibility of the right to contracted management of land mortgage. This part also carries on the analysis to the Chongqing city's experience of the right to contracted management of land mortgage financing, provides the practical foundation for the second part which is about the legal construction of the contracted management of land mortgage.The second part is the legal construction of the right to contracted management of land mortgage. According to the innovation of rural land rights mortgage in Chongqing City, this part mainly analyzes the legal system of the right to contracted management of land mortgage, and give the specific suggestions on how to design the regulation of the right to contracted management of land mortgage for financing.The third part is about measures of safeguard for right to contracted management of land mortgage implementation. Focus on how to grantee the rights of the pledge and the mortgagee through the regulation of the right to contracted management of land mortgage, and how can the government improve the survival protection for farmers, and promote the development of the right to contracted management of land mortgage implementation.
