Improve The Legal System Of Soil Environmental Quality Survey In China

Soil environmental quality survey system refers to the principle and rules of the competent authorities to understand and calculate the capacity of soil to contain,absorb and degrade various environmental pollutants according to relevant soil environmental quality standards and technical methods.Soil environmental quality investigation is helpful to understand the status of the specific soil environment.In environmental legal theory,the investigation practices precautionary principles and prudential principles,laying the foundation for environmental quality objectives accountability,public participation,and reason burden theory.At present,the soil environmental quality investigation system of our country faces many problems,such as the lack of legal norms,the lag of soil environmental quality standards,the lack of the system of enforcement mechanism and the lack of legal responsibility and the pursuit mechanism.The existence of these problems led to poor government supervision of soil pollution,resulting in great difficulties such as soil pollution responsible for the identification and accountability,and pollution control and repair.The legal system of soil environmental quality investigation system in the United States,Japan and Taiwan of China provides a useful reference for the establishment and improvement of the soil environmental quality investigation system in the legislation of soil pollution prevention and control in China.According to our present objective reality,with reference to extraterritorial legislation experience colligating theoretical analysis and empirical research results,we can build and improve the soil environmental quality survey system from the following four aspects:The first is to identify the start body of the soil environmental quality survey and the legal procedures.Secondly,it is necessary to stipulate the main formulator and main content of soil environmental quality archives.Thirdly,it is necessary to clarify the storage of soil environmental quality survey data,the disclosure of information and the handling of disputes.Finally,it is necessary to clarify the legal responsibility of soil environmental quality investigation.
