On The Consumer Council System’s Validity Of Protecting Consumers’ Rights In G Province

The consumer dispute is an unavoidable subject in every mature consumption market.The speed and the effect of resolving disputes have also been the yardsticks to measure the health of the consumption market,even the health of the whole society.Whereas,as the total retail sales of consumer goods increase,consumer disputes have also increased.Meanwhile,the difficulty of resolving disputes increases gradually.Among five legal methods to protect consumers’ legal rights and interests in our country,the Consumer Council is committed to such functions as accepting and investigating consumers’ complaints,mediating consuming disputes,resolving contradictions and protecting consumers’ legal rights and interests to relax the relation between consumers and operators,and promote the society’s harmonious and stable development.Based on the G consumer council of protecting consumers rights as the object,through the analysis of the validity,the main problems and solutions of the current consumer rights protection are studied in this paper.First,this paper introduces the background of consumers rights in our country,combined with the status and characteristics of G Province consumers rights in China,the significance and thoughts of this paper are determined.Second,presents the position and the attributes of G consumer council system in the whole rights-protection system through comparing and analyzing scopes of complaint acceptance,handling time,costs and legal effects of five different departments,which represent five methods of protecting rights in the rights-protection system in G Province,and thought discussing the relationship between the Administration of Industry and Commerce and the Consumers’ Council.On this basis,this paper classifies and compares the specific data of complaints accepted by the G Consumer Council in recent 5 years,the characteristics and validity performances of G Consumer Council’s protecting legal rights are summarized and analysed.According to these results,combined with the interview data,on the basis of the G Consumer Council’s attributes,position and its validity performances of protecting legal rights together to analyse the reasons of its validity shortage.Finally,for the cause of the problem,Finally,for the cause of the problem,the methods and thoughts are proposed to improve the efficacy problems of protecting legal rights from the function,the duty,the power,and the positon of the G Consumer Council.
