Market regulation is a basic function of modern government, and it is also one of the focus of people's attention. Guangzhou market supervision work has achieved remarkable results, but also faced with the huge regulatory pressure for a long time. In order to effectively solve the unlicensed, fake and shoddy, price fraud,infringement of intellectual property rights and other issues,2014, Guangzhou has started the huge ministry System Reform of market Supervision administration of municipality,In 11 districts, the integration of Bureau of Administration for Industry and Commerce(AIC), Bureau of Quality and Technical Supervision(QTS) and other departments set up the Bureau of Market Supervision Administration at the district level, in order to strengthen the supervision and management of the market access, the production and circulation of commodities(or services), and the consumer rights protection. However, the huge ministry system reform involves the vital interests of many departments, led to the resistance to reform; restricted the function of Bureau of market supervision and Administration. At the same time, the market structure is more complex, cross industry, cross regional illegal business behavior has become increasingly prominent, the people are full of expectations of government departments to solve these problems.As a starting point, this paper analysis the huge ministry system reform of market Supervision administration of Guangzhou municipality, from the public choice theory,regulation theory, in-depth analysis the outstanding problems in the process of reform:the first, the "inverted pyramid" type structure leads to the functions of deviation and the administrative supervision cost increase, "the tragedy of the commons" and the protection of consumer rights effort was "fragmented"; the second, the classificationof localization management institutions can also have risky, including the conflicting policies from different departments, different criteria in enforcement and local protectionism; the third, the unequal relation of authority and responsibilities formed "Authority Scissors" caused by excessive internal approval, transfer responsibilities from top to bottom and negative externalities.This study follow the huge ministry system reform logic, through the characteristics of the "limited rational economic man" of the department and the internal staff as a breakthrough, combining with the experience and lessons of both domestic and foreign, put forward practical proposal and countermeasures to Guangzhou: first of all, in accordance with the idea of "focusing on the service,strengthen executive" to promote the integration of departmental functions.Guangzhou need to integrate the Bureau of Administration for Industry and Commerce(AIC), Bureau of Quality and Technical Supervision(QTS), Bureau of Intellectual Property Office(IPO) and Price supervision department to set up the Market Supervision Administration of Guangzhou Municipality, the Bureau of Market supervision and Administration in every district needs to integrate the Bureau of Intellectual Property Office(IPO) and Price supervision department; to integration of internal market supervision and administration of municipality in the way of "merging similar items" to eliminate regulatory gap and reduce the regulatory costs.Considering the particularity and complexity at the food and drug supervision, it is necessary to keep the independence of the bureau of food and drug supervision.Secondly, in accordance with the concept of "ease market access and strict market regulation" to improve the structure of organization. Guangzhou needs to combine the huge ministry system reform with the group system, to set up the market regulation work leading group, to strengthen overall coordination; clarify existing legal norms,unified regulatory standards, ease market access and strengthen the regulation of things afterwards, build market supervision information platform, break departmental barriers to eliminate information islands. Thirdly, according to the accrual principle of reciprocity, smooth and clarify the relationship between the departments. Guangzhou needs to adopted the strategy of "system + discipline + technology", to strengthen thesupervision of regulators and the construction of administrative ethics, at the same time to strengthen the construction of industry self-discipline, to promote social organizations to undertake the government's market regulatory functions, giving full play to the advantages of information industry,to build a multiple co-government market regulatory system that include government, market and society.
