The Study On The Potential Influence Of Sino-U.S. Bilateral Investment Treaty On Chinese Enterprise Investment In U.S.

With the speed up of Sino-U.S. bilateral investment treaty negotiation process, there is a new growth period showed in the Chinese investment in U.S.. At the beginning of 2016, Haier announced its acquisition of General Electric's appliance unit, then Dalian Wanda announced the acquisition of Legendary Entertainment—a famous US film production company. A fact that the United States is one of the most popular country, in which investors favored doing investment. This mainly due to the U.S. has the huge market, advanced technology and good brand effect. However, more and more problems occurred in recent years, Chinese investment in the U.S., especially the investment in telecommunications, energy and other sensitive business got into many trouble.This paper studied on the potential influence of Sino-U.S. bilateral investment treaty on the Chinese investment in the U.S., based on the problems the Chinese enterprises meet and the U.S.2012 Bilateral Investment Treaty Model. First, this paper use case analysis. It analyze the two cases one by one, Huawei and Sany Group's investment failure case in the United States. Then it do comparative analysis of these two case, summed up the general problems when China's enterprises do investment in the United States. Finally, this paper get the conclusion through literature research and the analyze of the U.S.2012 Bilateral Investment Treaties Model. Through comprehensive analysis, we believe that the Sino-U.S. biateral investment treaty based on the U.S.2012 Bilateral Investment Treaties Model cannot solve the problem the Chinese enterprise meet in U.S., it also will bring new problems. At last, this paper put forward some suggestions to our government, industries and enterprise.
