The IPR Barriers Of China's Automobile Industry Under The Background Of "China Manufacturing 2025" And Its Countermeasures

Since the 1990 s,the knowledge-based economy has opened a new stage of trade liberalization and economic globalization and technical change has occurred in many areas.In order to seize markets and suppress China's rapid development,developed countries begin to use intellectual property barriers as a new trade barrier.Now,IPR barriers have become one of the major obstacles that China's international trade is facing.Due to lack of core technology,weak in independent innovation and IPR protection,automobile industry as the mainstay industry of China will suffer a lot in the wave of international intellectual property competition.In 2015,Chinese government announced the “China Manufacturing 2025” to change the ‘Big but not strong' status caused by the lack of independent innovation capability,to reduce IPR barriers attack by improve products' technical content and to achieve the goal of transforming from “Made in China” to “Created in China”.Under the guidance of management,economics and legal theory,putting IPR protection and its dispute settlement mechanism in the background of economic globalization,the article mainly used the methods of literature analysis,comparative analysis,econometrics and the game theory to conduct a comprehensive study of how international intellectual property protection develops and the intellectual property barriers headed by ‘Section 337 Investigation ' China facing and its countermeasures.The WTO dispute settlement mechanism with strong applicability and TRIPS Agreement are more and more used to solve international intellectual property disputes.After studying of the quantitative analysis between China's export volume growth and the number of ‘Section 337 Investigation',we concluded that substantial growth in exports,lack of patents and imperfect in intellectual property protection lead to encounter IPR ambush frequently.Further through the game theory inferred that the government-led settlement mechanism more conducive to long-term interest.Finally,points out the countermeasures to intellectual property barriers.The trinity cooperative game among China's relevant government departments,industry association and enterprises will promote the breakthrough in China's automobile industry and the realization of “China Manufacturing 2025”.
