Comparative Study On Information Technology Companies' Patent Strategy Between PRC And U.S.

In the social circumstances with increasing throat-cutting competition and changhing technical innovation, the information industry development has achieved remarkable successes, but also faced with severe challenges.Facing intellectual property rights competition from foreign enterprises who are inclined to capture the market, our information technology companies should improve the comprehensive ability to use the patent strategy,choose right patent strategy according to the technical innovation ability, the value of patent monopolization and the industrial environment, and also depends on dynamic adjustment to adapt to market competition actively. In the way, these enterprises can transfer the core advantages into the market competitiveness. The United States is the world's first and the most developed country implementing the patent strategy.Drawing on the experience and formulating the patent strategy suitable for our information technology companies is an important choice for upgrading the patent system.This paper describes more theory on it and then analysises the creation, application, protection and management in the patent strategic implementation process.First of all this paper describes the patent strategy study from the philosophical perspective about how the patent strategy is defined, content,principles and ways for realize it. Secondly,based on the current situation and problems of patent strategy in our country,it describes the cause of defect in the patent strategy process.Thirdly, it studys the patent strategy from America and then finds out the restrictions and barriers factors in the implementation of paten strategy in our country.Finally, according to the contrast between America and China on this issue, and drawing on the sucessful experience from European and American countries, Japan and India,it puts forward some measures perfecting our patent strategy.
