A Study On The Route Of Promoting The Rule Of Law In Colleges And Universities In China

Rule of law is the most reliable and lasting way to guarantee of scientific development in Colleges and universities.The progress is slow substantially even“Ministry of education in 2003 on the strengthening the higher education management by law” and “The outline of propel the higher education management in law in 2012” were published 10 years ago.What are the factors stopping the process of the law? And how to resolve these resistance factors,and explore the problem,it will help government,the administrative department of education,and the management of colleges and Universities to provide help,and propel the rule of law to promote our Institute.It analyzed the propelmanagingthe universitybylaw in institute of Chinaand its routeselection based on public universities of China by using the methods of literature review,comparative,historical analysis,policy analysis,expert interview.To explore the rule of managing the university by law and the status of Institute of China by comparing the situation in United States,Britain,Germany,Japan and other countries,then summarized the development of university system,the establish and improvementshould adapt to the national conditions,respect the dominant position of the university,pay more attention to the rule of law.Analyzed the principle and correct route that must be insist by the Institute of China by history analysis.Analyzed the main reasons that exist by policy analysis method.To put forward solving ideas and feasibility route for promote references to the higher education management by law.Conclusions:1.The history and experience of domestic of universities in domestic and overseas indicate that school autonomy,academic freedom,democratic management and social responsibility are the core concept in developing higher education;law is a rule system management of the University;the legislation is the most fundamental measures of university system construction;to establish,improve the system continuously and adapt to the situation of our university is the eternal pursuit of the university law.2.There is practical significance and historical significance to promote managing the university by law.Managing the university by law is the inherent requirement of the development of modern society to giving full play to the function of University,is an important guarantee to the socialist direction,and is a fundamental way of the modern university in China.3,The study found that the main factors that block the rule of law,including the higher education legislation is not perfect;administrative examination and approval system is not reasonable,decentralization is not enough,college autonomy is relatively small;some rules and regulations and existing laws contradictory,Education is based on the law of governance is relatively weak;government investment in colleges and universities,the introduction of social evaluation mechanism,scientific assessment and other management is not in place;on the rule of law and understanding of the existence of different views;according to the lawschool has not internalized into management Behavior;school affairs are not really implemented and so on.4.The key factor of promotingmanaging the university by law are continue to promote the decentralization of government from the external environment;system operation and scientific decision-making system from the campus environment;the rule of law culture fleshy.There is four principles to promote managing the university by law: effective leadership of the Communist Party of Chinese priority principle,internal governance priority principle,check and balance principle,comprehensive reform coordinate push forward principle.5.To promote the scientific way of managing universities by law: deepening the school management system and the reform of the governance structure,and make the rights legalization;to promote the comprehensive reform of the school systembase on the reform of personnel system;to establish the supervision system and execution mechanism of connotation development evaluation rules,the evaluation of the school from the extension type to the connotation type.
