The feminist legal theory arises in the sixties and seventies of the 20 th century involves a lot of schools of theories. Prof. Mackinnon,as a representative of feminism jurisprudence, has made outstanding contributions to the feminist legal thoughts. Feminism jurisprudence also emphasizes the differences between men and women. However, unlike other feminist schools, it stresses the negative difference between the sexes and puts the root of sexual inequality due to the existence of the patriarchy. And it suggests that the ways to the realization of equality between men and women,one is the ignorance of physiological differences between the male and female,the other is the elimination of social and cultural root of the inequality of male and female. Prof. Mc Kinnon once pointed out, it is the social culture that shaped the inequality between men and women. And the inequality between men and women, in turn, demonstrates and contributes to the culture of inequality between men and women.This paper, on the basis of a brief introduction of the various schools of thoughts on feminism, focuses on Mc Kinnon's theoretical point of view, makes a detailed introduction and comments on her perspectives towards sexual harassment, pornography, rape and rape law, and sexual equality so that we have a clear understanding of Prof. Mc Kinnon as well as her important theory viewpoints. Finally,combining the reality of legislation of women's rights and interests in our country, this paper analyzes Prof Mc Kinnon's feminist legal theory and concludes its enlightenment and reference to the sexual harassment legislation of our country, with an aim to better safeguard the rights and interests of women during the process of constructing the socialist law- administrated society.
