A Research On The Integration Of Duty Criminal Prevention And Detection

The dominant position of anti-corruption has been formed and cases of corruption has largely been decreased because of five years strong work on anti-corruption since 18 th CPC national congress,which takes time and space for the permanent solutions of anti-corruption.The CPC central committee and the Commission for Discipline Inspection of the Central Committee of the CPC have laid down a series of rules or documents within the Communist Party while fighting corruption,which indicate that the policy of anti-corruption has transformed from emphasizing treating symptoms to seeking both temporary and permanent solutions,and indicate that we are stepping forward to the target of letting officials be incapable of corruption and have no idea of corruption from no dare to corrupt,these means that the work of duty criminal prevention has also get a big developmental chance.As one of the most important institution on anti-corruption,the procuratorate has find out a relatively effective way which is the integration of duty criminal prevention and detection.According to the universal law of punishing and governing duty criminal,the prevention department and detection department have gradually enhanced the effect of punishing and prevention on duty crime by combining works,coordinating acts,integrating human resources and sharing information by each other.However,it doesn't take full affection because there are still many defects in this kind of mechanism.So it is urgently needed us to solve,which is how to create an effective hand grab that can turn the tables of anti-corruption and change the situation that the corruption cases become more and more if only rely on case handling by doing some work,such as carefully examining what problems exist in the integration of duty criminal prevention and detection,analyzing the causes,and making the mechanism better and more perfect.This thesis was written around these questions.It reexamined the history,connotation and features of the integration of duty criminal prevention and detection,expounded the background and conditions that the mechanism came into being,and explained the reasons of its emerging and development.In the second part it demonstrated that this kind of mechanism is scientific from basic theories including crime prevention theory,crime control theory and crime govern theory.For resolving some important questions such as the work departmentalism and the blocking of information sharing between case investigation department and duty criminal prevention department,many prevention leaks in the mechanism and its weak implementation,it made a special effort to investigate and study the reasons and conditions that causing these problem.At last,based on drawing on the experience of other countries and regions by the way of comparative analysis,it put forward the countermeasure proposals of how to build the integration of duty criminal prevention and detection according to the new situation and requirement since the 18 th CPC national congress.
