The Legal System Study Of “Network Virtual Property Inheritance Law” Under The Background Of “The General Civil Law”

"The general civil law of the People’s Republic of China" has a regulation on the new civil rights protection such as : the network virtual property and the data information.It also leaves space for other new civil rights protection.The one hundred and twenty-seventh term of "the general civil law" says the law has a regulation on the data and the protection of network virtual property,which suspended the academic theories of all kinds of characteristics of network virtual property dispute,and created the possibility of bringing it into the scope of the revising “inheritance law” as soon as possible.Before designing a new system of inheritance,I’ll review all kinds of theories of network virtual property ownership and sort out the existed legal sources of the network virtual property;With reference to some of the legislation,judicial practice outside,I‘ll summarize a lot of practice of the network virtual property inheritance to explore a series of problems in practice so as to bring it into the scope of inheritance as soon as possible,which is in response to the real requirements of the judicial practice and the people’s expectations,and also perfect our inheritance legislation.It is of great significance to promote the birth of "civil code" as soon as possible.This paper attempts to study these problems in theory one by one and think about the related regulations designing on network virtual property inheritance in our country.
