Civil Law Analysis Of Network Virtual Property Inheritability

Network virtual property is a development product of the information age, each the netizens with the increased use of the Internet, has gradually accumulated a large number of network virtual property. Such property not only has great value of the property, but also gradually contacts with the reality affairs with its peculiar value.The country’s legislation is still in a blank state about how to deal with the wealth after the Internet users dead. It caused widespread debate about related problems in academic and theoretical fields. Firstly, from the point of view of the law of property, this paper investigated the property attribute of the network virtual property, for this reason, to study the evolution and development of the concept of property, laid the foundation for the legal recognition of the existence of the network virtual property;and then analyzed its legal definition which should be identified as a property, it is not only to meet the basic elements of the property, but also there is no legal impediment to legal recognition of its property attribute; further argued that the inheritance of network virtual property can be incorporated into the system of the existing inheritance law, and then thought what reality problems will be lead to about the network virtual property inheritance, and put forward suggestions for improvement, to the benefit of the relevant judicial practice.
