An Investigation Report Of Lawful Promotion Of Urban-village Renovation In Taiyuan City From The Ecological Compensation Perspective

The third plenary session of the 18 th Central Committee of the Communist Party of China reiterated a strategic concept of ecological civilization on ‘ Beautiful China ’ proposed in the report of the 18 th National Congress of Communist Party.Meanwhile,it clearly proposed urbanization construction as an important part of the top-level design in economic development.On March 16,2016,the 13 th five-year plan passed by National People’s Congress further explained the promotion strategy of new urbanization in China.As a unique product in the process of rapid urbanization,reforming the village in the city become critical nodes in advancing urbanization strategy.It referred to some difficult problems such as the change of ownership of collective land and reform of the administrative management.Therefore,it is commonly to see that the local governments ignored the protection of ecological environment when they legitimize the promotion of transformation of village in City.However,confronted with constantly emerging cases of negative external effect during the rapid economic development,ecological environment issues brought by the urbanization should be paid highly attention by environmental law cycle.In this paper,based on the background of urbanization process in Taiyuan,adopting the perspective view of ecological compensation,the author investigated and researched on ecological environment problems caused in the process of transformation of village in city and studied relating administrative actions by government in recent years.Through the research method of questionnaire investigation,interview,data statistics as well as empirical analysis,the writer learnt a lot about problems existed on ecological compensation in the process of transformation of village in city,and then the writer made a pertinent analysis about their reasons.In the last,the author gave corresponding countermeasure suggestions.The writer truly wish those suggestions can be taken into consideration when cities of Taiyuan and other brotherhood cities make their decisions in their urbanization construction.This paper mainly consists of four parts.The first part is about an overview of my research and investigation,including research backgrounds,research objects,research methods,and research content.The second part is about research results.The author summarized and combed problems in three aspects.They are the basic situation,the current legal basis and the ecological compensation status in advancing transformation of village in city.In the third part,the writer first put forward the problems existed in the ecological compensation jobs during the process of transformation of village in city and then give a detailed legal analysis.In the fourth part,aim at the problems found above,the writer gave a final perfect countermeasure and suggestions on the view of ecological compensation.
