Freedom of speech is a basic right of citizens.Article 35 of the Constitution clearly stipulates this.With the maturing of network technology,Internet space has become the main position for citizens to express their opinions.Cyberspace speech has different characteristics from traditional speech.On the one hand,it can promote personal progress and social development.On the other hand,it often causes conflicts with other basic rights and state power.As an extension of traditional speech,cyberspace remarks need us to determine its boundaries in order to better implement this basic right entrusted to citizens by the Constitution.To determine the boundaries of cyberspace speech,the constitution and law is support and guarantee.The basic rights entrusted to the citizens by the Constitution require various laws and regulations to make further specific protective provisions,and to build a solid legal defense against cyberspace remarks.The balance of law and interests is the key to establishing a legal boundary of freedom of speech.When this freedom of citizens conflicts with the legitimate rights and interests of other citizens and the public power of the country,specific analysis needs to be made on individual cases.Whether citizen’s speech belongs to the scope of protection,and whether it constitutes an infringement of other citizens’ rights or damages the public interest of the country is reasonably explained to determine how to protect or limit citizens’ cyberspace remarks.In the field of cyberspace remarks,the lack of legal and moral literacy of citizens and lax enforcement by the executive authorities are the major problems at present.The purpose of defining the boundaries of cyberspace speech is to regulate the state’s responsibility and clarify citizens’ personal obligations,so as to protect the basic rights entrusted to citizens by the Constitution properly.
