The Comparative Study Of The Protective System For Discharged Persons From Prison Among Cross-strait

The protective system for discharged persons from prison,as the name suggests is the system to help and support released prisoners.It focuses on the possibility that criminals are unable to return to society after accepting social penalties,and the possibility of recidivism is very large.So,to help the released prisoners to integrate into the community normally and reduce the risk of recidivism,it is a must to carry out the necessary help and protection measures.Mainland China's protective system for discharged persons corresponds to the resettlement and education system,while the Taiwan region is a rehabilitative protection system.For this reason,the author has adopted a comparative study method.By comparing the protective system for discharged persons from prison on both sides of the strait,we have a better understanding of the protection of prisoners after their release from prison,and so that we can find out the new breakthroughs in the mainland's resettlement and education system.This paper is divided into three parts.The first part mainly elaborates the reason of studying this subject.In this part the author describes the practice status and the existing problems of the system of resettlement and education in mainland China.And in addition the author analyses the cause of the resettlement and education system carefully,including the position of the protection system is unclear,the lack of standardization,the lagging ideas of protection system.The second part describes thebasis of comparison.The author firstly summarizes the features of the rehabilitative protection system in Taiwan.Then the author compares the protective mode for discharged prisoners of United States,Japan,China Taiwan and other representative countries and regions,pointed out that Taiwan's rehabilitative protection mode gets a very strong reference value.The third part elaborates what we can learn from on the comparison foundation,that is the systematic perfection of the resettlement and education system.Based on the current economic and social foundation,the author points out the concrete opinions which can learn from the rehabilitative protection mode.
