Study On The Rights And Interests Protection Of Military In China

The protection of military rights and interests is an important basic project in the const ruction of our army,which is closely related to the vital interests of the officers and soldier s and the security and stability of the army.The military is not only a special group to defe nd the national sovereignty and protect the interests of the people,but also a special group with high devotion and high risk.Therefore,the protection of the rights and interests of the military has different connotations different from the protection of the rights and interests of other social strata.It is of great significance to strengthen the military cohesion,combat effectiveness and national defense security.In this paper,empirical analysis and comparati ve research methods are used to analyze and discuss the rights and interests of the military and how to protect them effectively.The paper is divided into four parts.The first part of the military,the military status of the military and the concept of military rights and interests of the legal analysis,combined with the unique characteristics of military personnel out of the military interests are differe nt from other related rights and interests of the relevant characteristics.The second part rev iews the historical development of our country’s military rights and interests,and summariz es the relevant provisions of the existing laws and regulations on the protection of military rights and interests.The third part elaborates the insufficiency of the protection of the right s and interests of the military in the legal system and the military level.The main manifesta tion is that the legal guarantee system is imperfect,the existing regulations are not operatio nal,the legal relief mechanism is not perfect,the system design is unreasonable,the subjec t law enforcement is not in place,Accountability is not implemented and other six aspects.The reasons for these problems are multifaceted,not only by the legislative cultural factor s,but also with the traditional tradition of misunderstanding and special power relations factors are not unrelated.Finally,the author puts forward some tentative ideas and ideas on perfecting the rights and interests of our military.From the transformation of the rights and interests of military personnel to protect the concept of strengthening the legislative guarantee,improve the judicial relief,and promote military and other multi-faceted,at all levels to improve the protection of our military rights and interests of the system,to achieve strong military goals to provide strong backing.
