With the development of the car rental industry,a new crime pledges leasing vehicle defrauded for funds used for personal use shows a high trend.Emphasizing on this type case,the cognition of the courts in different places is different,and the accusation is also different,the main dispute focuses on this type should be identified as the crime of fraud or contract fraud,how to cognate the behavior of the pre and post vehicle cheat,as well as the cognition of the victims and the determination of the amount of crime,etc.This paper first introduces the current situation and causes of the crime of car rental fraud,and then quotes four different effective cases,analyzing the differences of the judging thoughts among cases.Introducing the similarities and differences between fraud and contract fraud,the car rental fraud is a crime or a few crimes,discusses the relationship between the nature of behavior of the pre and post vehicle cheat and pre and post behaviors.Then,introducing the cognition of victim of car rental fraud,the amount of crime,and the protection of the right of the pledgee,etc.,putting forward the proposal to prevent the car fraud.Hoping to clarify the above legal relationship through the discussion of this paper,clearing the judging thinking of car rental fraud case so as to avoiding the case of "same cases have different judgments",fully showing the justice of the judiciary.
