On The Legal Surpervision Of Community Correction

Community correction,refers to the community will meet the conditions of correction,minor offenses,little harm to the conditions of the prisoners placed in the community to serve their sentences,by the specialized agencies of their service process management supervision,extensive invitation of various social resources to participate in the sentence transformation process,while the establishment of collective education,social labor,regular reports,restrictions on migration and so on the obligation to serve an open implementation of dynamic penalties.Community reform system has been introduced for more than ten years since the development of various institutional mechanisms are maturing,but the operation of the system continues to reveal the many shortcomings are still widespread.Some problems such as the main body of operation,the corrective mechanism,the legal authorization,the disciplinary discipline and the means of safeguarding have already affected the healthy and orderly operation of this system to a certain extent.Especially in recent years,the community prisoners detained,missed,false tube cases continued to increase,even in the correction of the community and the implementation of serious vicious violence,community correction is facing its security,effectiveness of torture.More seriously,the community correction supporting supervision and control mechanism is often absent,responsible for community correction management work grassroots judicial administrative staff corruption,dereliction of duty cases continue to high incidence,has become a new hot spot in corruption cases,new areas.This shows that the operation of the community correction system is not perfect,the institutional mechanism has not yet straightened out,there are many basic problems or contradictions need to be studied and resolved.To resolve the above problems in community correction,it is a basic and fundamental idea to strengthen the legal supervision of community correction work by procuratorial organs.Since the procuratorial organs began to assume the legal supervision of community correction work,criminal enforcement departments throughout the country have been engaged in this work for several years,it can be said to accumulate a very valuable practical experience.But in this period of procuratorial supervision practice,also exposed in the supervision of the work carried out in a number of institutional issues.These problems have both contradictions inherent in the operation of our procuratorial powers,and the uniqueness of the distinction between other procuratorial powers as a result of the particularity of community corrections.With the criminal judgments of light punishment,non-realization of the concept of deepening and the case rate continues to rise,the community correction system itself is facing the best development opportunities in history,the prosecution community correction work will also take test from the history of the grim.In this regard,the procuratorial organs must understand the situation,take the initiative as a focus on the current community correction system and the corresponding legal supervision work to do a systematic study of a comprehensive and objective look at their own work,research problems and determine the future direction of development,with a view to the future work better to lay a solid foundation.This paper is divided into four parts,namely,the introduction,the problems and difficulties in the operation of the community correction system,the analysis of the existing problems of community correction and supervision of the procuratorial organs,and the realistic way to enhance the effectiveness of community correction.This paper intends to elaborate on the concept of community correction and the analysis of the current problems and difficulties in the operation of community correction system,and gradually discuss the manifestation of procuratorial supervision in community correction work.At the same time,it puts forward the realistic path of improving the effectiveness of community correction legal supervision from the real dilemma faced by community correction legal supervision.Some of the ideas presented in this paper are based on the problems encountered in practice or some personal thinking based on the direction of practical development and still need to further explore the revision in the practice of community correction law supervision.
