When the Central Committee of the Communist Party of China put forward the power list system in the third Plenary Session of the 18 th CPC Central Committee,it can be said that this system is the embodiment of Chinese characteristics combined with the specific local areas of China.Therefore,we can say that the emergence of this system conforms to the requirements of the reform of the administrative system.There are still many stubborn problems in the current administrative system of the country.If we want to deepen the reform of the administrative system,it is necessary to ensure the effective implementation of the system of power list.The system is like a sharp sword that can push the process of reform.Although the State Council put forward the system in 2013,the system has been practiced in2005.For example,in 2005,Handan was used as a pilot city to practice the system.This system began to be mentioned in China.Although some achievements have been achieved at the beginning of practice,the system shows a prairie prairie trend from 2013 to 2016.That is,the system has developed very rapidly during this period.The bill of rights system is concerned with the integration and decentralization of administrative power,so the system is widely concerned and deepened by experts and scholars in law field as a topic.In 2013,the Central Committee put forward the policy requirements for the implementation of the system in the local area.At this time,it was closer to the people and more closely with the practice.This paper takes the list system of local government power as the research object,and discusses the government power list at the municipal level and the county level.At the same time,it also involves part of the provincial government power list.There are five parts in this article: the first part is the introduction.It also contains the following four parts:The first part is mainly the theoretical analysis of the system.There are four aspects.First,it introduces the basic connotation of the list system of the local government power,the list of the power of the local government,and the relationship between the three lists,such as power,responsibility and negativity.Two,it expounds the characteristics of the list.It is also divided into general and unique characteristics.The general feature is that the list must be open to the society,the list should be constrained and the content should be clear.Unique list,which has characteristics of the interests of the game and the difference;three is due to the power list system is composed of a policy document to be standardized,the lack of legal regulation,there is no uniform standard,so it is necessary to analyze the legal attribute of the local government’s power list.Two main points of view existing in the academic circles are discussed further.In this paper,the author also puts forward his own views on the list of power of local governments.The four is to analyze the theoretical foundation of establishing the system.It is based on the theory of "people’s sovereignty","limited government" and "information disclosure".Finally,the necessity of establishing the system is explained.That is,it not only maintains the civil rights,but also effectively controls and standardizing the power of the local public.It also plays a certain role in promoting the construction of the government under the rule of law.The second part mainly analyzes the practical exploration of the top level design.The first is to comb the system from the emergence to the implementation of the detailed map.In2005,Handan announced the mayor’s "list of powers",which was the earliest example in practice.Zhengzhou,Hunan Province,and so on following Handan also announced the list of powers.The system has been developing in a bad way,but the system has developed rapidly since 2013.In the third Plenary Session of the 18 th CPC Central Committee,it was proposed to "carry out the power list system of local governments at all levels and their work departments,and to open the process of power operation according to law." The eighteen session of the fourth session clearly pointed out that "the implementation of the government power list system,simple government and decentralization,to achieve administrative power to lose weight,let the government lean." In 2015,the state issued some guiding opinions about the implementation of the system.It clearly pointed out that "before the end of 2015,the provincial government and the municipal governments at the two level before the end of2016 will basically complete the formulation and publicity of the list.The central plan and strategic deployment of the system are stipulated by the Central Committee in the series of meetings and documents.The second is to analyze the effectiveness of the system.For example,the power and responsibility of the organs and their functional departments are further clear,the procedure of the system operation and the wide range of social achievements of the system are set up.The third part is to introduce the shortcomings in the process of the development of the system.For example,there is a lack of relevant laws and regulations in the list,the lack of strict compilation procedures,the standardization of production standards,and the lack of strict supervision mechanism.The existence of these deficiencies is a stumbling block to the development and implementation of the system.Finally,in view of the shortcomings of the system,some suggestions and countermeasures are put forward in this paper.We should improve the relevant laws and regulations of the list of local government power,make diversified development of the list makers,standardize the formulation procedures,determine the establishment standards and establish a diversified supervision mechanism. |
