With the development of network technology,it becomes a new way to express and communicate through the network,and it is constantly deepening our life and changing our way of expression.Freedom of speech on the Internet as an extension of the traditional freedom of speech,not only shows the promotion of democracy,the rule of law and the protection of the basic rights of the advantage,but also bring infringement of privacy,the spread of terrorist violence information,even endanger national security and a series of new problems.How to adapt to the times and promote the healthy development of free speech,has become an important issue in the construction of the rule of law in China.Free legal regulation of Internet freedom of speech is to restrict and supervise the freedom of expression by laws and regulations.Germany,the United States and other developed countries,the Internet started earlier than China,its network of freedom of expression is also relatively perfect legal regulation.The principle and characteristics of some common rules and regulations are worth learning from.China’s legal regulation on freedom of speech on the Internet,although it has experienced ten years of development,has made great achievements,but there are still some problems,mainly reflected in: the problem of legal level confusion,poor operability,focus on supervision,ignore the protection of the rights.The reasons for the formation of the above problems are various,both legislative deficiencies,but also the defects of the system,but also the concept of the rule of law needs to gradually penetrate the reasons.In this paper,using the methods of literature research,comparative analysis,content analysis,the longitudinal expansion form,through the analysis and the existing problems of legal regulation of the status quo of China’s freedom of speech on the Internet,the perspective of a number of paths to improve China’s legal regulation of network freedom of speech.Strive to have a relatively complete observation and understanding of the legal regulation of freedom of speech in our country.The proposed strengthening legislative plan and enhance the maneuverability,clear legal boundaries,to ensure that the law regulation,establish the views of law consciousness,restriction and protection of both legislation and refinement,hope for the future work of the legal regulation of network freedom of speech plays a certain degree of reference.
